Classic PIO Partners Royalty Free End User License Agreement

This is a legal agreement between you and Classic PIO Partners. By opening this package you agree to be bound by the terms of this agreement. If you do not accept or agree with these terms, return the unused and unopened Classic PIO Product and all original packaging within fifteen (15) days of purchase to the person from whom you acquired it for a full refund.

Classic PIO Partners grants to you a non-exclusive, non-transferable license to use this copy of the Classic PIO product, including the images contained therein and any accompanying documentation according to the following terms and conditions:

You may install the Classic PIO Product in only one computer. You may make one (1) copy of the Classic PIO Product in machine readable form solely for back-up purposes, provided that you reproduce all proprietary notices on the copy. You may physically transfer the Classic PIO Product from one computer to another, provided that it is used on only one computer at a time, with one user at a time. You may not use the Classic PIO Product on more than one computer or workstation at a time in a network or multi-user system.

All Classic Photographic Image Objects (PIO) may be reproduced (copied, modified or incorporated) royalty-free, in print and digital publications, presentations and multimedia projects. The Classic Photographic Image Objects may not be repackaged and/or resold in the form of clip art, digital stock photography or print photography collections. You may not make (or allow anyone else to make) any form of copy, whether digital, printed, photographic or otherwise, of any of the images in this Classic PIO Product, except insofar as such images may be incorporated by you into on-screen or printed material. You may not place (or allow anyone else to place) any of the images in this Classic PIO Product on an electronic bulletin board or other form of on-line service. You may not rent, transfer, distribute or grant any rights in the software, the images contained therein and/or the accompanying documentation in any form to any person without the prior written consent of Classic PIO Partners. You may not use (or allow anyone else to use) any of the images in this Classic PIO Product in any form of pornography, the determination of which is left to the sole discretion of Classic PIO Partners. You may not use Classic PIO images to create Òfor resaleÓ items, such as mugs, clothing, hats, buttons, postcards, posters, books, souvenirs, gift items, or any other resale products that feature Classic PIOs. Use of Classic PIO images in these types of Òfor resaleÓ products may require the purchase of additional licensing rights. In addition, you may not export or re-export the Classic PIO Product in any form without the appropriate United States and foreign government licenses. Your failure to comply with this provision is a material breach of this Agreement.

This license is not a sale. Title and copyrights in and to the software, reference images, accompanying documentation and any copy made by us remain with Classic PIO Partners or its suppliers or licensers.

Unauthorized copying of the Classic PIO Product images or the accompanying documentation or otherwise failing to comply with the terms and conditions of this Agreement will result in automatic termination of this license and will make available to Classic PIO Partners other legal remedies. Upon termination of this Agreement, the licenses granted herein will terminate and you must immediately return all licensed material and all backup copies thereof, to Classic PIO Partners. Copyright infringers will be prosecuted to the fullest extent of the law.

Warranties
Classic PIO Partners warrants that it has the right to grant this license to you. Classic PIO Partners warrants the disc to be free from defects in material and workmanship for ninety (90) days from delivery as evidenced by a copy of your receipt. Your sole and exclusive remedy for a breach of these warranties is the replacement of the disc or refund of the purchase price and the termination of this Agreement, at Classic PIO PartnersÕ option. CLASSIC PIO PARTNERS MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some states do not permit the exclusion of implied warranties and you may have other rights which may vary from state to state.

Limitation of Liability
CLASSIC PIO PARTNERS SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFIT OF LOSS OF USE, ARISING OUT OF THIS LICENSE OR OTHERWISE.

This Agreement will be governed by the laws of the State of California. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force effect. If you have any questions regarding this Agreement, please contact us in writing at the address below.

WARNING: All copyright and trademark interests related to this software are proprietary to Classic PIO Partners, with all rights reserved. We cooperate with the Software Licensing Association, and prosecute infringers to the fullest extent of the law. If you have any doubt about the validity of a proposed use, do not risk prosecution.
