GRANT OF LICENSE0
Wolters Kluwer Health, Inc.-Lippincott Williams & Wilkins grants you a personal, nontransferable, nonexclusive, nonsublicensable right to use the LifeART/ MediClip image(s) you have selected to download onto your computer hard drive (or other storage device) and to use the LifeART/MediClip image and any derivatives or copies (collectively, the "Image") on one computer and with one user at a time. The publisher, Wolters Kluwer Health, Inc.-Lippincott Williams & Wilkins, retains ownership of the Image(s) as well as any subsequent copies on any media or in any form. Your License to the LifeART/MediClip Image(s) grants you, the purchaser, permission to use, modify, and include LifeART/MediClip Image(s) in other documents and materials, as part of a total graphic design, for yourself, your client, or your employer, subject to the following limitations:

FOR EDUCATIONAL USE:

· a credit reading, "LifeART (and/or) MediClip image copyright (appropriate year) Wolters Kluwer Health, Inc.- Lippincott Williams & Wilkins. All rights reserved." should appear adjacent to the Image(s) or in an obvious credits page or screen;

· you may incorporate up to 10 LifeART/MediClip Images in any single work from any one collection. To incorporate more than 10 LifeART/MediClip Images in any single work, please contact our Licensing Department at licensing@fotosearch.com. Additional licensing fees may be applied.

· the Image(s) may not be distributed, sublicensed or made available for use or distribution as art for reproduction (clipart), any form of stock design, prints, negatives, positives, mats, engravings, etc., without written permission from Wolters Kluwer Health, Inc.- Lippincott Williams & Wilkins; and no rights to the Image(s) may be granted other than the right to use the Image(s) as part of the product made by you;

· Image(s) used in electronic form, including multimedia applications and Internet or intranet sites, should be for viewing purposes only, i.e., prepared as embedded or inline graphics, and cannot be in a downloadable or FTP format;

· pornographic, defamatory, libelous or otherwise unlawful use of the Image is prohibited.

FOR RESALE PURPOSES:

· you may make the image available to ten (10) separate individuals (cumulatively over the Term) for the sole purpose of manipulating or otherwise using the image to create the End Use according to the terms provided herein in any and all media now known or hereafter devised
·you must obtain an additional license and are subject to additional fees to make the Content available to more than ten (10) individuals. Please contact our Licensing Department at licensing@fotosearch.com. Additional licensing fees may be applied.

Except as specifically provided above, you may not copy this Image.

WARRANTIES
Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins warrants the digital copy of the Image(s) in the form downloaded by you to be free from defects in material and workmanship for 90 days from delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the digital copy of the Image(s) or refund of the purchase price, at Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins's option. WOLTERS KLUWER HEALTH, INC.-LIPPINCOTT WILLIAMS & WILKINS MAKES NO OTHER WARRANTY OR REPRESENTATION, EITHER EXPRESS OR IMPLIED, WITH RESPECT TO THIS IMAGE(S), INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Some states do not permit the exclusion of implied warranties, and you may have other rights which may vary from state to state, NEITHER WOLTERS KLUWER HEALTH, INC.-LIPPINCOTT WILLIAMS & WILKINS NOR ITS LICENSORS SHALL BE LIABLE TO YOU FOR ANY GENERAL, SPECIAL, DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR OTHER DAMAGES ARISING OUT OF THE LICENSE OF THE IMAGES.

RETURN/REFUND POLICY
Due to the fact that there is no physical product return, LifeART does not offer returns or refunds for purchased images. For questions regarding this policy please contact LifeART at licensing@fotosearch.com.

GENERAL
This License is governed by the state of Maryland and shall benefit Wolters Kluwer Health, Inc.-Lippincott Williams & Wilkins, its successors, and assigns. Licensee consents to jurisdiction in the state and federal courts located in the state of Maryland.

All rights to the Image are owned by Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins and its licensors and are protected by United States copyright laws, international treaty provisions and other applicable laws. Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins and its licensors retain all rights not expressly granted by this agreement. The Image is licensed only to you and may not be transferred without the prior written consent of Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins.

The license contained in this agreement will terminate automatically without notice from Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins if you fail to comply with any provision of this agreement. Upon termination, you must immediately (i) stop using the Image and, (ii) delete the Image and all copies from all magnetic media and destroy all other copies of the Image, or upon request of Wolters Kluwer Health, Inc. - Lippincott Williams & Wilkins, return all such copies to Lippincott Williams & Wilkins. Your use of the Image must be in compliance with all applicable law, including, but not limited to, laws and regulations relating to currency and the law of moral rights. Use, duplication or disclosure of the Image by the United States is subject to "Restricted Rights," as that term is defined in the Department of Defense Supplement to the Federal Acquisition Regulations ("FAR"), and to paragraph 52.227-19(c)(2) of the FAR.
